Why Horton & Mendez for your Lyft accident case

Former insurance defense attorneys on your side

Our managing partners at Horton & Mendez previously worked for insurance companies. We spent years learning how insurers evaluate rideshare claims, assign fault, and push for minimal settlements. Now we use that insider knowledge to fight for you. When Lyft’s insurer deploys delay tactics or disputes over which policy covers your crash, we’ve already anticipated their strategy because we used to run it ourselves.

Multiple attorneys, 65+ years of combined experience

Our team approach means multiple lawyers review your claim, build your strategy, and prepare for every argument the other side might raise. You don’t get handed off to a paralegal and forgotten. You get a team that knows how the other side thinks.

Multiple offices across North Carolina

Whether your Lyft accident happened in Raleigh, Wilmington, Charlotte, or anywhere in between, we’re accessible. With multiple office locations statewide and more on the way, we’re never far from where you need us.

Common Lyft accident cases we handle

Lyft accidents come in many forms, and the type of crash directly affects your claim. Here are the most common scenarios we see across North Carolina.

Passenger injuries

If you were riding in a Lyft when a crash occurred, you may have claims against the driver, Lyft’s insurer, or both. Passenger claims are often more straightforward since you weren’t behind the wheel, but navigating Lyft’s tiered insurance structure still requires guidance from lawyers who handle these cases regularly.

Collisions with other vehicles

If a Lyft driver hit your car, the available insurance depends entirely on whether the driver was actively transporting a passenger, waiting for a ride request, or logged off the app. Pinpointing the driver’s app status at the moment of impact is one of the first things we investigate.

Pedestrian and cyclist injuries

Pedestrians and cyclists struck by Lyft drivers often face severe injuries and complex insurance questions. These cases require rapid preservation of evidence, including trip data and app records, before that information is lost or overwritten.

Multi-vehicle crashes

When multiple vehicles are involved, several insurance policies come into play simultaneously. Each insurer tries to shift blame away from their policyholder. We coordinate across all parties to ensure your claim doesn’t fall through the cracks.

How NC law affects your Lyft accident claim

North Carolina has specific rules that directly impact rideshare injury cases. Understanding these rules is critical to protecting your right to compensation.

Insurance coverage depends on driver status

North Carolina regulates rideshare companies under North Carolina General Statute Chapter 20, Article 10A (Transportation Network Companies). Under § 20-280.4, TNC drivers or transportation network companies must maintain primary automobile insurance, and the required coverage level shifts based on the driver’s status at the time of the accident.

Driver offline (app is off): Only the driver’s personal auto insurance applies. Lyft provides no coverage during this period.

Driver logged on, awaiting a ride request: The insurance must recognize the driver as a TNC driver, and specific automobile insurance requirements apply while the driver is logged on to the app but not providing TNC service. Coverage during this window is typically lower than during an active trip.

Driver engaged in TNC service (en route to or transporting a passenger): NC law requires primary automobile liability insurance of at least $1M for death, bodily injury, property damage, or any combination in a single accident, plus combined uninsured and underinsured motorist coverage.

Here’s what makes rideshare claims especially tricky. Personal auto insurers in North Carolina may exclude all coverage for any loss occurring while a driver is logged on to a TNC app, including liability coverage for bodily injury and property damage. If the driver’s personal policy includes that exclusion, Lyft’s insurance must provide the required coverage from the first dollar of a claim. We know how to identify these coverage gaps and hold the right insurer accountable.

NC’s contributory negligence rule

North Carolina is one of only a handful of jurisdictions following a contributory negligence standard. Under this rule, injured individuals who are even partially responsible for their injuries cannot recover any damages. Insurance companies know this and will aggressively try to pin a fraction of blame on you. We build cases that anticipate and defend against those fault arguments from day one.

Don’t let the insurance company use NC’s strict fault rules against you. Call 910-405-7751 before they build their case.

Our process for Lyft accident cases

We keep things simple so you can focus on getting better.

Free consultation. Call us or fill out our online form. We’ll review the facts and tell you whether we can help. No cost and no obligation.

Investigation. We gather police reports, Lyft trip data, the driver’s app status at the time of the crash, medical records, and witness statements. We identify every available insurance policy and all liable parties.

Case building. We document your injuries, calculate the full value of your damages, and prepare a demand that accounts for what you’re owed now and in the future.

Negotiation or litigation. We negotiate aggressively with Lyft’s insurer and any other carriers involved. If they won’t offer fair compensation, we’re prepared to take your case to court.

What compensation can you recover?

Every Lyft accident case is different, but injured individuals in North Carolina can generally pursue compensation for:

Medical expenses: Emergency care, surgeries, hospital stays, rehabilitation, medication, and future medical treatment.

Lost wages: Income lost during recovery and future earning capacity if your injuries are long-term.

Pain and suffering: Physical pain, emotional distress, and the overall impact on your daily life.

Property damage: Vehicle repair or replacement and damaged personal belongings.

Loss of enjoyment of life: When injuries prevent you from doing the activities you used to enjoy.

In cases involving reckless or egregious conduct, punitive damages may also be available. The value of your claim depends on injury severity, the strength of the evidence, and the insurance coverage in play.

Frequently asked questions about Lyft accident claims in North Carolina

How much does it cost to hire a Lyft accident lawyer?

At Horton & Mendez, we work on a contingency fee basis. You pay no upfront costs or fees unless we win. We only get paid if you get paid. Your initial consultation is completely free.

How long do I have to file a Lyft accident claim in NC?

North Carolina’s statute of limitations for personal injury cases, including motor vehicle claims, is three years from the date of the accident. However, waiting can hurt your case. Evidence disappears, and insurance companies use delays to their advantage. Contact us as soon as possible.

What if the Lyft driver’s personal insurance denies my claim?

This is common. Under NC law, personal auto insurers may exclude coverage for any loss that occurs while a driver is logged into a TNC app. When that happens, Lyft’s commercial policy must step in and provide coverage. We identify which policy applies and pursue the right insurer on your behalf.

What if I were partially at fault?

Contributory negligence means that if an injured person is even 1% at fault, they cannot recover anything. Insurance adjusters will look for any reason to shift blame onto you. That’s exactly why you need lawyers who understand defense tactics. We anticipate these arguments and build your case to counter them.

Does Lyft’s $1M insurance policy always apply?

No. The $1M primary liability coverage requirement applies while a TNC driver is engaged in TNC service. That means they’re en route to pick you up or actively transporting you as a passenger. If the driver was logged on but waiting for a ride request, different coverage requirements apply. We investigate the driver’s exact app status to determine the available coverage.

Do I have to go to court?

Most Lyft accident cases settle through negotiation without going to trial. However, if the insurance company won’t offer fair compensation, we’re fully prepared to litigate. We’ll advise you on the best path forward based on the specifics of your claim.
