How NC Workers’ Compensation Benefits Work

Under the NC Workers’ Compensation Act, benefits are paid for periods of “disability,” which is defined as the inability to earn pre-injury wages. It’s a no-fault system, meaning you don’t have to prove your employer was negligent. You just need to show the injury happened at work or because of your job.

The NC Industrial Commission administers the Workers’ Compensation Act and oversees every claim in the state. The Commission is headquartered in Raleigh at the Dobbs Building at 430 N. Salisbury Street, and all settlements must be approved through its process. Understanding the benefit categories available to you is the first step toward making sure you receive everything you’re entitled to.

Disability Benefits: TTD, TPD, PPD, and PTD

North Carolina recognizes four categories of disability benefits. Each one applies to a different stage of your recovery.

Temporary total disability (TTD)

If your injury keeps you from working entirely, you may qualify for TTD benefits. TTD pays two-thirds of your average weekly wage, up to the applicable maximum weekly compensation rate. For 2026, that maximum is $1,446 per week, and it’s adjusted annually. No compensation is paid for the first seven days of lost time unless the disability continues beyond 21 days, at which point payment for those first seven days is included. For claims arising on or after June 24, 2011, TTD benefits are payable for up to 500 weeks from the date of first disability, unless the employee qualifies for extended compensation.

Temporary partial disability (TPD)

TPD benefits apply if you can return to work in some capacity but cannot earn your full pre-injury wages. The benefits pay partial wages until you return to full-time work. You’ll receive two-thirds of the difference between your pre-injury earnings and your current earnings, subject to the same weekly maximum.

Permanent partial disability (PPD)

Once you’ve reached maximum medical improvement, your doctor may assign a permanent impairment rating. PPD benefits are calculated on a percentage basis according to a schedule of injuries, and the percentage of disability is determined based on physicians’ ratings of physical permanent impairment. North Carolina General Statute § 97-31 assigns a specific number of weeks of compensation for the loss or partial loss of use of different body parts.

Permanent total disability (PTD)

PTD benefits are reserved for the most catastrophic injuries. You may qualify for PTD if you’ve suffered the loss of both hands, both arms, both feet, both legs, or both eyes (or any two), a spinal injury involving severe paralysis, a severe brain or closed-head injury, or burns covering 33% or more of your body. PTD benefits are paid at two-thirds of your average weekly wage and can extend beyond the 500-week TTD limit.

Medical Benefits And Vocational Rehabilitation

Medical benefits

NC workers’ compensation covers “medical, surgical, hospital, nursing, and rehabilitative services,” as well as medicines, sick leave, and other treatment. The employer or its insurance carrier provides and directs medical treatment, subject to any Commission orders. If you’re dissatisfied with the care you’re receiving, you may petition the Commission to change physicians or approve a doctor of your own choosing when good grounds are shown.

Medical benefits are separate from the disability benefits discussed above and do not offset or reduce your disability payments.

Vocational rehabilitation

If your injury prevents you from returning to your previous job, you may be entitled to vocational rehabilitation services under N.C. Gen. Stat. § 97-32.2. These services can include vocational assessment, job development and placement, skills testing, work adjustment counseling, on-the-job training, or education through the North Carolina community college or university systems. You can request vocational rehabilitation if you haven’t returned to work or if you’ve returned to work earning less than 75% of your pre-injury wages.
